Lukas Rossi Wins, Supernova Loses

E! Online reports Tommy Lee, Jason Newsted, Gilby Clarke, CBS and Mark Burnett Productions were served with an injunction which prohibits them from using the name Supernova to profit in any way. This includes record sales, tours and promotional items. The cease and desist was served as the result of a complaint by a punk rock trio also named Supernova.

The members of the original Supernova filed a trademark infringement lawsuit in July. Originally all of the above were listed in the suit, but that is no longer the case. While Lee, Newsted and Clark are no longer defendants, CBS and Burnett are still being named in the suit. Even though the punk rock group hasn’t had a hit or toured in years, it was the judge’s contention they didn’t intend to abandon their name. (Wonder if they would have given it a second thought if they didn’t see the name splashed across the television screen every Wednesday night.)

Attorneys for Burnett and CBS cried foul however, stating they purchased the rights to the name fair and square from the person who holds the trademark.

The lack of a name didn’t take away from the evening’s festivities, however. Rossi beat out early favorite Dilana Robichaux, and contenders Toby Rand and Magni Ásgeirsson to front the supergroup on tour and in the studio. No word as to what their new name will be.
