In the early morning hours of September 25, 2007, Sutherland was stopped in Los Angeles, California, for making an illegal U-turn. He failed a field sobriety test and was arrested.

DUI Charge

Sutherland’s blood alcohol level registered above the legal limit of .08, but the actual level has not been released. He was arrested on a misdemeanor driving under the influence charge. The actor was booked at the police station in Hollywood and was released a few hours later after posting bail in the amount of $25,000. He was formally charged on September 28, 2007. If convicted, he faces up to one year in county jail plus fines. If his probation is revoked, as prosecutors are urging the judge to do, he could face an additional six months behind bars.

What Came Before?

Shortly before his arrest, Sutherland was seen attending a party celebrating the new Fox TV fall lineup at Area, a trendy local night club. Sutherland stars as Jack Bauer on the network’s hit series “24,” a role for which he received a best actor Emmy last year.

Prior Conviction

Sutherland is still on probation for a 2004 misdemeanor DUI charge, for which he received a sentence of five years probation and 50 hours community service. He also underwent alcohol treatment as a result of that conviction.
